Terms of Service

1. Acceptance of terms

By creating an account or using ComplySite, you agree to these Terms of Service.

2. Description of service

ComplySite is a subcontractor compliance tracking tool. It is a tracking and reminder aid — it does not constitute legal, compliance, or safety advice, and does not guarantee compliance with any law, licensing requirement, or WHS obligation. Builders remain solely responsible for verifying the accuracy and validity of any subcontractor's documents and for their own compliance obligations.

3. Account registration

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials.

4. Subscription, billing, and payment

• ComplySite is offered on a subscription basis, with pricing tiers as published on our website
• Payment is collected via Stripe, billed monthly in advance
• Invoices for past and upcoming charges are available in your account's Billing section
• Refunds: fees already paid for the current billing period are non-refundable, including on cancellation or downgrade mid-cycle. We may issue a refund at our discretion in the case of a genuine billing error or extended service outage attributable to us.
• Downgrades: take effect at the start of the next billing cycle, not immediately. A downgrade will be blocked if your current usage (e.g. active projects or subcontractors) exceeds the limits of the lower tier, until usage is brought within those limits.
• Failed payment: if a payment fails, we'll attempt to retry it and notify you. If payment isn't resolved within 7 days, your account will be moved to a suspended, read-only state (existing data remains visible, but new uploads, invites, and edits are disabled) until payment succeeds or the account is cancelled.

5. Cancellation

You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of your current paid billing period — you retain full access until then, with no partial-period refund. After cancellation, your data is retained for 90 days (see Privacy Policy §10) in case you choose to reactivate, after which it is securely deleted.

6. Acceptable use

You agree not to use ComplySite to upload false or fraudulent documents, to misrepresent a subcontractor's compliance status, or to use the service for any unlawful purpose.

7. Data ownership

Builders retain ownership of the data they and their subcontractors input into the platform. ComplySite acts as a processor of this data in providing the service, as described in our Privacy Policy.

8. Service availability

We aim to keep the service available and reliable but do not guarantee uninterrupted access. We are not liable for losses arising from service downtime.

9. Limitation of liability

To the maximum extent permitted by law, ComplySite is not liable for any indirect, incidental, or consequential damages arising from use of the service, including reliance on compliance status information that later proves inaccurate due to a subcontractor's own document fraud or a technical failure.

10. Termination

We may suspend or terminate an account for breach of these terms, non-payment, or unlawful use.

11. Changes to these terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance.

12. Governing law

These terms are governed by the laws of Victoria, Australia.
